Unpaid Wages and Overtime?

Employers will go to great lengths to pay you less than you are owed. Many unscrupulous employers make their profit on the backs of employees who are underpaid. Employers will misclassify employees as exempt from overtime, or force them to work off the clock. Many employers will fail to keep records that would assist you in proving that you are owed unpaid wages. Fortunately, California employees are protected against such illegal conduct.

Denied Meal and Rest Periods?

Employees are entitled duty free meal periods after more than five hours after starting work unless the workday will be completed in six hours. Employees are entitled to paid rest periods of ten minutes for each four hours of work. Some employers will actually work their employees through their meal period and go so far as to require the employee to clock off and continue to work. The employer is required to keep records showing when you meal period started and stopped.

Questions about your rights as an employee?

There are many little-known laws that protect employees from the conduct of employers. These include laws and court decisions regarding workplace safety, searches at work, drug testing, medical exams, certain criminal or arrest history inquiries, credit reports, eavesdropping, privacy and other issues.

Considering bringing a class action?

A class action is a lawsuit where the plaintiff serves as a “class representative” and brings the case on behalf of other people who have similar claims. In the employment law context, the class representative-employee has claims common to other employees. It is usually more efficient for the court to handle the claims of many employees at one time, without each employee filing their own case.

Are you the victim of discrimination?

Are you the victim of illegal discrimination? Have you been denied promotion, assigned to a less favorable job, terminated or otherwise treated unfairly because of your age, disability, sex, national origin, sexual orientation, pregnancy, race or religion? Have you been retaliated against or fired because you complained? You may file a claim with state and federal agencies and proceed to bring action to vindicate your rights.

Have you been fired illegally?

Job security is an essential element of a stable life. Unlawful practices by employers are rampant in California. In many cases, employees may be fired for no reason at all, while in other cases, workers’ rights are protected under union contracts or statutes. Many laws are in place that protect workers, such as anti-discrimination, anti-retaliation and whistleblower laws.
