Unpaid Wages and Overtime?

Employers will go to great lengths to pay you less than you are owed. Many unscrupulous employers make their profit on the backs of employees who are underpaid. Employers will misclassify employees as exempt from overtime, or force them to work off the clock. Many employers will fail to keep records that would assist you in proving that you are owed unpaid wages. Fortunately, California employees are protected against such illegal conduct.

Denied Meal and Rest Periods?

Employees are entitled duty free meal periods after more than five hours after starting work unless the workday will be completed in six hours. Employees are entitled to paid rest periods of ten minutes for each four hours of work. Some employers will actually work their employees through their meal period and go so far as to require the employee to clock off and continue to work. The employer is required to keep records showing when you meal period started and stopped.

In the employment law context, the class representative-employee has claims common to other employees. It is usually more efficient for the court to handle the claims of many employees at one time, without each employee filing their own case.
