This case involved California computer related employees of OAS Healthcare Solutions, Inc. who alleged they were improperly classified as exempt employees and not properly paid overtime compensation. This case was resolved in 2005.

This case involved assisted living home employees who allege they were improperly paid and not meal and rest breaks. This case was resolved.

BRUTON v. ROUND TABLE DEVELOPMENT COMPANY

Tehama County Superior Court Case No. 59106

This case involved employees of Round Table Pizza restaurants who missed meal periods and missed rest breaks. This case was resolved in 2008.

BUTLER-MITCHELL, ET AL v. LIBERTY MUTUAL INSURANCE GROUP

Sacramento County Superior Court Case No. 01AS06879, coordinated in Los Angeles Superior Court.

This case involved California insurance adjusters for Liberty Mutual Insurance Group, which includes LIBERTY MUTUAL FIRE INSURANCE COMPANY, LIBERTY MUTUAL INSURANCE COMPANY, LM INSURANCE CORPORATION, LIBERTY INSURANCE CORPORATION, LIBERTY LIFE ASSURANCE COMPANY OF BOSTON, THE FIRST LIBERTY INSURANCE CORPORATION, EMPLOYERS INSURANCE OF WAUSAU A MUTUAL COMPANY, WAUSAU BUSINESS INSURANCE COMPANY, WAUSAU UNDERWRITERS INSURANCE COMPANY and GOLDEN EAGLE INSURANCE CORPORATION. The adjusters allege that they were production employees entitled to receive hourly wages, but instead were improperly classified as exempt employees and not paid overtime compensation. This case has been resolved.

This case involved overtime compensation for California Route Sales Representatives and pay for missed meal and rest breaks. This case was resolved in 2008.

CHATFIELD v. HERTZ LOCAL EDITION

Sacramento County Superior Court Case No. 02AS0604.

This case sought to obtain overtime compensation for California managers of Hertz Local Edition offices that were misclassified as exempt managers, although primarily performing non-exempt duties. Damages are also sought for missed meal and rest breaks. This case was resolved in 2004.

CICERO v. MOUNTAIN CENTER, INC. and IRONWOOD COMMUNICATIONS, INC.

San Bernardino County Superior Court Case No. VCVVS 043274.

This case involves California employees who allege missed meal and rest breaks and seek reimbursement for equipment purchased to perform their jobs. Case was resolved in 2010.

CLOK v. CONSOLIDATED ELECTRICAL DISTRIBUTORS, INC.

Sacramento County Superior Court Case No. 06AS00933.

This case involved California employees who alleged the non-payment of overtime compensation, missed meal period and missed rest breaks. This case was resolved in 2007.

COE vs. ANNA’S LINENS

Orange County Superior Court Case No. 04CC00660.

This case sought to obtain overtime compensation for California managers of Anna’s Linens that were misclassified as exempt managers, although primarily performing non-exempt duties. Damages are also sought for missed meal and rest breaks for all employees. This case was resolved.

This case involves employees who allege they were not provided meal and rest periods and were improperly paid.

CROSBY v. CHEVY’S

Sacramento County Superior Court Case No. 06AS02420.

This case involved California employees of Chevy’s restaurants who alleged missed meal period and missed rest breaks. This case was resolved in 2008.

CUNNINGHAM v. ATT WIRELESS SERVICES

Orange County Superior Court Case No. 03CC00174, coordinated in Santa Clara County Superior Court.

This case involved the back charging of commissions to California salespersons of cellular phones and services. When a customer cancels service in the first 180 days, the salesperson was charged back the commissions previously paid. The plaintiff alleged this is a violation of California Labor Code section 221. This case was resolved in 2007.

DELCOL v. SECURITAS SECURITY SERVICES USA, INC.

Ventura County Superior Court Case No. SC044343, coordinated in Santa Clara Co.

This case sought to obtain compensation for California employees who alleged damages for missed meal and rest breaks. This case was resolved in 2009.

DENNO v. GMRI, INC.

This case sought to obtain overtime compensation for California managers of Red Lobster that were misclassified as exempt managers, although primarily performing non-exempt duties. Damages are also sought for missed meal and rest breaks. This case was resolved in 2007.

This case sought to obtain overtime compensation for California managers of stores who were misclassified as exempt managers, although primarily performing non-exempt duties. Damages were also sought for missed meal and rest breaks. This case was resolved in 2006.

This case involved California employees of Dewey Pest Control who alleged they were improperly classified as exempt employees and were not properly paid overtime compensation. This case was resolved in 2005.

This case involved California employees of Denny’s restaurants who alleged missed meal period and missed rest breaks. This case was resolved in 2007.
