Defendant moved to compel arbitration and asked the court to allow arbitration on an individual basis only, not as a class, even though the Plaintiffs had filed their complaint as a class action. The court granted the motion to compel arbitration, but rejected Truly Nolen’s request that it be individually arbitrated. The issue of whether the parties agreed the arbitration contract to permitted class arbitration was remanded to the lower court. Truly America v. Super. Ct.
